Terms & Conditions
The following General Terms and Conditions are the exclusively applicable terms and conditions of the contractual relationship between Prestige Beverages AG, Wolframplatz 11,8045 Zurich (hereinafter “PB”) as operator of the website “www.guerdon-champagne.com” and the purchaser of products offered on this website and the app (hereinafter “Customer”). The general terms and conditions apply exclusively. Deviations from these terms and any additional agreements shall only be binding for PB if they are agreed in writing with the customer.
The order, including the order for the dispatch of the ordered goods, shall be deemed to have been placed and the order order accepted as soon as the customer has accepted these General Terms and Conditions of Business via the Internet by pressing the “Accept General Terms and Conditions of Business” button and the order has been placed.
3 Prices and terms of payment
All prices are quoted in Swiss francs (CHF) including VAT. PB reserves the right to make price changes. Such price changes have no effect on goods already ordered. The payment of the ordered goods by the customer takes place either by invoice or via the credit card chosen by him by releasing the amount over Internet in the intended input window for payment. In individual cases PB reserves the right to demand payment in advance after receipt of the order.
Guerdon Champagne does not have a minimum order value.
The delivery area covers the whole of Switzerland and Liechtenstein. The goods ordered will be delivered to the delivery address specified by the customer when placing the order. Delivery is made via Swiss Post with PostPac Priority on working days without signature. In the case of delivery by landfill, PB cannot assume liability in the event of loss or theft. Orders placed before 3 p. m. will be delivered the next working day. If delivery is not made within this period, an additional period of three working days shall apply. If the delivery has not been received by the customer within this period, he has the right to withdraw from the order in return for reimbursement of the purchase price and transport costs. PB accepts no liability for consequential damage due to delayed delivery.
As a matter of principle, PB undertakes to offer only goods of impeccable quality, which meet all requirements of Swiss legislation, on “www.guerdon-champagne.com” and to publish correct data regarding the properties of the goods for sale. If incorrect or defective goods (breakage bottles) were delivered, the customer must notify PB of the defect within five working days of delivery, by e-mail [email protected] or by post. If no goods have been delivered, the customer has to contact PB within 1 year from the date of delivery. If this notification is made in time, the customer will be credited with the corresponding amount to his account. If the goods originally ordered are no longer available, the customer will be reimbursed for the purchase price and shipping costs (in case the customer has only ordered the returned wine). The following rule applies to cone wines: The value of the goods can be credited to the customer’s account within 2 years, provided that the affected bottles are still filled to 2/3 and returned to us.
6 Obligations of the customer
The customer guarantees that he is authorised to conclude the contract in accordance with applicable law, in particular that he is eighteen years old. It is the customer’s responsibility to enter the correct delivery address. The customer must check the delivery within five working days at the latest. Damaged/incorrect delivery items shall be kept at PB’s disposal for return. The customer expressly authorizes PB to pass on the entered order data to the respective wine merchant who delivers the ordered goods. The data may also be used for sending newsletters/promotions etc. in the wine sector. Any further use or distribution is excluded. The customer authorizes PB to make copies and electronic recordings (log-files) of any transactions for verification purposes.
7 Exclusion of liability
Any liability on the part of PB and its assistants for direct or indirect damage, errors or other disadvantages which may arise to the customer from the use of the order or the purchase of the goods, which goes beyond the liability provided for in section 5, is – insofar as legally permissible – excluded.
8 Intellectual property rights
The customer acknowledges that all intangible rights to names/descriptions, designs, concepts and software related to the “www.guerdon-champagne.com” website, irrespective of their special legal protectability, are the sole property of PB.
9 Data protection
All credit card data is transmitted via certified SSL technology (encryption technology) and secure e-commerce. The customer’s credit card number is therefore always protected and is not readable by third parties.

11 Choice of Law and Jurisdiction
This legal relationship is subject to Swiss law. The exclusive place of jurisdiction is PB’s registered office.
